I would like to make a request under the Freedom of Information Act 2000 in relation to an appeal submitted by Clarendon Surgery & The Angel Medical Practice (Practice Code: P87634) concerning the October 2025 Adult Seasonal Influenza Vaccination claim.
I would therefore be grateful if you could provide copies of the papers considered by both the NHS Greater Manchester Direct Commissioning and Contracting Panel (DCCP) and the NHS Greater Manchester Primary Care Commissioning Committee (PCCC) when they considered our appeal.
In particular, I would appreciate copies in relation to DCCP 18/03/26 & PCCC 25/06/26 meetings of:
· the agendas
· any reports, briefing papers or officer recommendations;
· any papers prepared specifically to support the Panels in reaching their decision; and
· the minutes (or relevant extracts) relating to our appeal.
I appreciate that these documents may contain confidential information relating to other practices or individuals. I am not seeking information that would identify other practices and would be happy to receive anonymised or redacted copies where appropriate.
In the Chief Commissioning Officer’s decision letter dated 26/06/26, it states:
“This decision aligns with previous cases, including similar appeals from other areas, and reflects the need to maintain consistency across the system.”
As this is specifically referenced within the Committee’s decision, I would be grateful if you could provide a little more information about the previous cases referred to.
In particular, could you please advise:
· how many comparable appeals relating to late submissions, have been considered over the past five years;
· in anonymised form, the circumstances of those appeals, whether the exceptional circumstances were accepted, and whether the appeal was upheld or rejected; and
· whether any appeal relating specifically to the Adult Seasonal Influenza Vaccination Programme has been upheld during that period and, if so, anonymised details of the circumstances.
I would also be grateful for copies of any policy, guidance or framework relied upon by the DCCP and/or PCCC when considering whether exceptional circumstances justify the exercise of discretion in contractual appeals, together with any guidance relating to how business continuity arrangements are considered as part of contractual appeals.
Finally, I would appreciate copies of the current Terms of Reference for both the DCCP and the PCCC.
