I request an electronic copy of:

  1. The breach notice dated 11 December 2025 issued to Eastway Pharma Ltd concerning Offerton Pharmacy, 513 Hempshaw Lane, Offerton, Stockport, SK2 5TP.
  2. The document, report, decision, investigation findings or correspondence setting out the specific grounds and factual circumstances giving rise to that breach notice.
  3. Any subsequent remedial notice, response, reconsideration or decision concerning that breach notice.
  4. The complete NHS Resolution decision and associated public documents concerning the subsequent appeal against that breach notice, including any written reasons for the determination.
  5. Any document identifying the particular provisions of the NHS (Pharmaceutical and Local Pharmaceutical Services) Regulations or pharmaceutical terms of service said to have been breached.

Where any information contains personal data or otherwise exempt material, please provide a redacted copy rather than withholding the document in its entirety.

  1. A breach notice was issued to this pharmacy contractor about this pharmacy, but it was issued on 11th December 2024.
  2. The breach notice arose following a complaint by a patient who stated that the pharmacy changed their nomination without their consent. A remedial notice was issued but not responded to by the pharmacy contractor.
  3. It was discussed at the Pharmaceutical Services Regulations Committee on 27th September 2024 and determined that in order to remedy the breach of the Terms of Service a Remedial Notice should be issued requesting a formal response from the Pharmacy Contract provide
  • an audit of the SOPs, ensuring all staff members have read/signed them
  • audit of smartcard usage with confirmation/assurance to NHS GM
  • ensure all staff members have read attached information “Important reminder pertaining to patient EPS Nomination and patient choice”

The remedial notice was issued on 23rd October 24 with a deadline of 5pm on 22nd November 24.

  1. Eastway Pharma Ltd did appeal the breach notice, we received the outcome from NHS Resolution on 24th March 2025 (SHA26416). Just to note in the report from NHS Resolution it does state that the breach notice was dated 11 December 2025 which is incorrect, it was dates 11 December 2024..
